The rampant abuse of working men and women by contractors who cheat them out of their lawful wage and benefits is a significant issue to New York State Building and Construction Trades Council and the 250,0000 members it represents.
We support this bill because it forecloses a scam practiced by unscrupulous contractors and assists in the efficient enforcement of the prevailing wage laws. But more must be done – more attention must be paid to enforcement and more resources must be provided to the enforcers of the prevailing wage laws so that honest contractors are not disadvantaged, and workers receive what is statutorily required.
Most important, although the NYS Building & Construction Trades Council supports measures to improve enforcement of the existing prevailing wage laws – meaningful reform will only be achieved by the Legislature undoing years of court-inflicted limitations on which projects are subject to the prevailing wage requirements. Only when the Legislature clarifies in unequivocal terms that prevailing wages must be paid on all projects receiving tax payer resources will the men and women the NYS Building Trades represents be truly protected.
